Terms of Service

These Terms of Service ("Terms") govern your access to and use of Viral Character, including our website, studio, APIs, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to the organization.

You must be at least 13 years old (or the minimum age in your country) and able to form a binding contract. You may not use the Service if you are barred under applicable law or if we have previously suspended your account for violation of these Terms.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@viralcharacter.app if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, pose security risks, or remain inactive for extended periods, subject to applicable law.

Certain features require credits or a paid subscription. Prices, credit allowances, and plan features are described on our website or billing pages and may change with notice where required.

Paid subscriptions renew automatically unless canceled before the renewal date. Refunds are provided only where required by law or explicitly stated in a promotion. Free-tier credits and promotional offers may expire or be modified at our discretion.

You retain ownership of scripts, media, and other materials you upload or create ("Your Content"). You grant Viral Character a worldwide, non-exclusive license to host, process, reproduce, and display Your Content solely to operate and improve the Service (including AI processing, storage, rendering, and delivery).

You represent that you have all rights necessary to use Your Content with the Service and that Your Content does not infringe third-party rights or violate law.

You agree not to:

• Generate or distribute illegal, harassing, defamatory, hateful, or sexually exploitative content
• Impersonate others or misrepresent affiliation without permission
• Infringe intellectual property, privacy, or publicity rights
• Attempt to bypass credit limits, security controls, or rate limits
• Reverse engineer, scrape, or abuse the Service except as permitted by law
• Use the Service to train competing models on our outputs without written consent
• Upload malware or interfere with Service operation

We may remove content or suspend access that we reasonably believe violates these rules or applicable law.

Outputs produced by the Service (including scripts, voices, and videos) may be inaccurate, incomplete, or unsuitable for your intended use. You are responsible for reviewing outputs before publication and for compliance with platform rules (e.g., TikTok, YouTube, Instagram) and advertising disclosure requirements where applicable.

We do not guarantee that outputs will be unique, error-free, or free of third-party claims. Similar outputs may be generated for other users.

Viral Character and its licensors own the Service, software, branding, and documentation, excluding Your Content. You may not copy, modify, or create derivative works of the Service except as allowed by these Terms or written permission.

Feedback you provide may be used by us without restriction or compensation.

The Service may integrate with third-party sign-in, hosting, payment, or social platforms. Your use of those services is subject to their terms. We are not responsible for third-party products or sites linked from the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALIX AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You will defend and indemnify Viral Character against claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may terminate or suspend access with or without notice if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends; sections that by nature should survive (e.g., ownership, disclaimers, liability limits) will survive.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protections in your country require otherwise. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires a different forum.

We may modify these Terms by posting an updated version on this page. Continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the Service.
